The Service uses artificial intelligence, including large language models, to generate responses based on user-uploaded content. While we strive for accuracy, AI-generated responses may occasionally be incorrect or incomplete.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3.3 Account Restrictions

You may not share your account credentials with others or allow others to access your account. Each user must have their own account.

4. User Content

4.1 Ownership

You retain ownership of all content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited license to process, store, and use that content solely for the purpose of providing the Service.

4.2 Responsibility

You are solely responsible for your User Content and the consequences of uploading it. You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate any third party's intellectual property or privacy rights

You may not upload content that:

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Ask360 and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Payment Terms

7.1 Subscription Plans

The Service offers various subscription plans with different features and limits. Details of each plan are available on our pricing page.

7.2 Billing

Paid subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method for the applicable fees.

7.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of the current billing period.

7.4 Refunds

Refunds are handled on a case-by-case basis. Please contact support for refund requests.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. You may export your User Content before termination. After account closure, your data will be deleted or anonymized within 30 days, as detailed in our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. AI-generated responses may contain inaccuracies and should be verified independently.

10. Limitation of Liability

IN NO EVENT SHALL Ask360, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ask360 and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your violation of these Terms
• Your violation of any rights of a third party, including intellectual property rights
• Any content you upload to or process through the Service

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.

15. General Provisions

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ask360 regarding the Service and supersede all prior agreements and understandings.

Waiver: The failure of Ask360 to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
